Agreed upon rental terms

The following are the terms and conditions agreed to herein by anyone renting from East Somerset Storage or its affiliates.  This applies to anyone that has had a lease in the past, present, or future.  


You have an obligation to inform us immediately of address or phone number change.


1) This tenancy shall automatically extend each succeeding month until tenant delivers to East Somerset Storage Mailbox of their intent to vacate. Notice must be given at least 10 days prior to vacating. 

2) Rent is due exactly one month from the date you rent unit each month or prior to the end of an extended lease. Unit number must be on payment if mailed to East Somerset Storage LLC. Rent shall be considered delinquent if not received by rent date each month and subject to “LOCK OUT”. Any rent that is not paid at time of “due date” will be charged a LATE FEE of $10.00. Any rent not paid before the 20th will be charged a LATE FEE of $20.00 and if rent is not paid by the end of the month, an OVER-LOCK FEE  of $15.00 will be charged. Making a total of $35.00 for entire month. In addition to late fees, funds received shall first apply to late charges and then to rent. In the event of “LOCK OUT”, rent shall be charged at the same rate until paid in full. 

3) A fee of $50.00 will be charged for all returned check. Also, your unit will be subject to “LOCK OUT” any time we are holding your returned check. 

4) NONPAYMENT OF RENT. At any time that you are in default, you may be “LOCKED OUT” of your unit or your lock may be removed. Any time you are “LOCKED OUT” of your unit, if you remove East Somerset Storage lock it will constitute breaking  and entering and tenant WILL BE prosecuted. After you have paid your unit with cash or money order then over-lock will be removed the following day. If paid by check it will be removed when check clears. If you request lock to be removed same day then there will be a minimum $25 charge. Further, if tenants lock need to be cut, tenant MUST contact East Somerset Storage to have lock removed. Tenant is NOT permitted to remove. 

5) YOUR PERSONAL PROPERTY STORED WITHIN UNIT CAN BE SOLD! AT ANY TIME TENANT IS IN DEFAULT ON RENT OR OTHER CHARGES, EAST SOMERSET STORAGE, HAS A LIEN ON SAID PERSONAL PROPERTY. IF LIEN IS NOT SATISFIED, YOUR PERSONAL PROPERTY CAN BE SOLD TO SATISFY LIEN. IF PERSONAL PROPERTY DOES NOT BRING A SUFFICIENT AMOUNT TO SATISFY LIEN, TENANT WILL BE HELD RESPONSIBLE FOR BALANCE. ( KRS-359.220). FURTHER, THERE MAY BE ADDITIONAL CHARGES DUE BESIDES RENT, SUCH AS, LATE CHARGES, LOCK REMOVAL, LEGAL FEES, POSTAGE, INTEREST, OR MOVING CHARGES IN THE EVENT EAST SOMERSET STORAGE CHOOSES TO REMOVE PROPERTY FROM UNIT. (KRS-355.7-209) 

6) Tenant shall not connect any heaters or any other electrical devices in any unit. If light is left on there will be a minimum $10 charge. 

7) Tenant agrees to use unit for storage of property wholly owned by tenant . Further, yard sales are NOT allowed on East Somerset Storage Property.

8) Tenant agrees to not store contents valued at over $2500.00 total unless otherwise stated. 

9) Security deposit shall be refunded in full if tenant leaves unit in good state of repair. Removes ALL their goods, broom swept clean and has met all their obligations under this agreement. Further, tenant is obligated to pay for entire month of rental. Tenant MUST be out of unit , lock removed and contact East Somerset Storage LLC to receive full refund. In the event damage to unit exceeds deposit, tenant agrees to promptly pay for damages in full and to be fully responsible for damages to said unit. 

10) Tenants Property is stored at tenants sole risk. East Somerset Storage is not engaged in the business of storing goods for hire and no bailment is created under this agreement. East Somerset Storage does not have nor take care , or control over tenants property. East Somerset Storage only rents space.  All of tenants property stored within or upon the storage unit shall be at tenants own sole risk. East Somerset Storage, its agents or employees shall not be liable for any loss of or damage to any personal property while at the storage facility arising from any cause whatsoever, including, but not limited to fire, water damage, burglary, mysterious disappearance, rodents, acts of God, or the active or passive acts or omissions or negligence of East Somerset Storage its agents or employees.
Tenants further agree to hold harmless East Somerset Storage for any losses that may occur to goods stored, or for bodily injury or death to tenants or anyone else that may be on facility property as a result of their use of the unit or facility, even if such injury is caused by the active or passive acts or omissions or negligence of East Somerset Storage LLC its agents or employees. 

11) East Somerset Storage advises all tenants to keep their property that is stored at this facility INSURED. East Somerset Storage provides NO INSURANCE whatsoever on tenants property. 

12) Tenant grants East Somerset Storage the right to remove lock and enter unit if tenant is in default or if an emergency situation arises. 

13) Tenant is strictly prohibited from storing hazardous or toxic materials at facility. Tenants obligation of indemnity as set forth in this rental agreement specifically include any cost, expense, fines, or penalties imposed against East Somerset Storage LLC arising out of the storage or use of such materials by tenants, his agents, employees, or guests. Tenant shall not store: food, seed, explosives or ammunition, inflammable(gas, fuel, paints, etc.) animals, hazardous or toxic materials, rubber tires, odor producing materials or poisons including rat/mouse poison. 

14) Tenant shall not be allowed to operate any business our of unit, nor will they be allowed to do any work within the unit or on the premises. There is a 2-hour maximum limit to spend at unit after move in.
